Specific service scope, pricing, timelines, and deliverables are defined in written proposals, agreements, or statements of work.
3. Messaging & SMS Communications
By submitting your phone number through our website, forms, calendar bookings, or audit requests, you expressly consent to receive communications from Flomexa, including:
- SMS messages
- Phone calls
- Emails
Messages may include:
- Audit follow-ups and onboarding communication
- Appointment confirmations and reminders
- Service updates and operational notifications
- Marketing or promotional messages
Message frequency may vary.

4. Compliance With U.S. Laws

Clients using messaging or automation systems provided by Flomexa are responsible for obtaining proper consent from their own customers before messaging them.
5. No Guaranteed Results
Flomexa does not guarantee specific outcomes, including revenue, lead volume, search rankings, or conversion rates. Marketing performance depends on multiple factors beyond our control, including competition, market conditions, ad spend, and client responsiveness.
6. Client Responsibilities
Clients agree to:
- Provide accurate business information
- Grant necessary platform access
- Obtain lawful consent before contacting their customers
- Use services in compliance with applicable laws
- Respond to requests in a timely manner
Delays caused by missing information or approvals may affect timelines.
7. Payments & Billing
- Fees are agreed upon prior to service delivery
- Late or unpaid invoices may result in service suspension
- Advertising spend, SMS usage, call usage, and third-party tools are billed separately unless otherwise stated
8. Intellectual Property
Flomexa retains ownership of its proprietary frameworks, automation logic, templates, and methodologies. Clients retain ownership of their data, branding, and customer information.
9. Third-Party Platforms
Flomexa integrates with third-party platforms such as GoHighLevel, Twilio, Google, Meta, Zapier, and others. Flomexa is not responsible for platform outages, carrier filtering, policy changes, or pricing updates imposed by these providers.
10. Limitation of Liability
To the maximum extent permitted by law, Flomexa’s liability is limited to the fees paid by the client in the thirty (30) days preceding the claim. Flomexa shall not be liable for indirect, incidental, or consequential damages.
11. Termination
Either party may terminate services according to the applicable agreement. Outstanding balances remain payable upon termination.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict-of-law principles.
13. Updates to These Terms
Flomexa may update these Terms periodically. Continued use of our services constitutes acceptance of the updated Terms.
